Administrator/DER Training
Drug Free Workplace Programs are very effective when developed and operated properly. Department of Transportation regulated must appoint a specific Designated Employer Representative (DER) to manage and communicate with others regarding testing of regulated employees. Whether a company program is designed to prevent the negative effects of alcohol & drugs from entering the workplace, or to just limit the losses due to employee substance use or to fully comply with Department of Transportation (DOT) requirements for Aviation, Trucking, Pipelines, Maritime, Railroads or Transit Systems, ALL programs must be developed and operated within industry or regulatory guidelines. The DOT testing regulations have become the industry standard affecting ALL employer programs.
This training program is specifically designed to cover ALL the elements of effective programs, whether regulated or non-regulated and to educate those who are charged with the responsibility to run those programs. The Administrator/DER has specific responsibility and challenges that others in the organization may not ever have to face. Knowing what the rules are and how to apply them is essential if the organizations program is to achieve its goal of being a "true" drug free workplace.
The Department of Transportation (DOT) changed the drug testing regulations,
49 CFR part 40, a number of times since August 1, 2001 when the DOT
alcohol and drug testing regulation underwent it's major re-write. Each of DOT Agencies have also had a number of
changes. Each employer is responsible for understanding how these changes
affect your organization. This program gives you a complete copy of the
DOT testing Rule, 49 CFR Part 40 and covers all of the appropriate Agency rule
changes. For the non-DOT regulated employer this program shows how
the courts and other administrative law judges (unemployment, workers'
compensation hearing officers) treat employer testing programs.
