Who may collect urine specimens for DOT drug testing?

§40.31 Clearly establishes that as of August 1, 2001 ONLY those individuals who meet the training requirements of §40.33 may act as collectors.

What are the training requirements of §40.33?

§40.33 establishes that there are 2 basic elements to the training required:

  1. Basic classroom training on the Rule 49CFR Part 40, The DOT Urine Specimen Collection Procedures Guidelines, all the steps to correctly completing a collection, "problem" collections and how to handle them, Fatal and Correctable flaws and how to correct them and the collectors responsibility for security and integrity of the specimen collected and shipped.
  2. Initial Proficiency Demonstration which is the completion of 5 mock tests under the direct observation of a trained collector who then must attest in writing to these collections being "error free."

Do long term employees who have been doing collections for years have to be trained?

Yes although the Rule allowed experienced collectors time to comply ALL collectors must be trained in the new rules and demonstrate proficiency by completing 5 "error free" mock collections by January 31, 2003.

When do New employees have to be trained?

Any individual hired after August 1, 2001 MUST complete the above training BEFORE conducting any DOT test collections

Is any other training required?

Yes MRO’s, SAP’s Collectors and Breath Alcohol Technicians all have Qualification, Error Correction and Refresher training requirements to meet. ADATC's training class explains all these requirements

Who Can Train collectors?

§40.33 Clearly establishes that the trainer must be an "individual who has demonstrated necessary knowledge, skills and ability by:

  1. Conducting DOT collections for a year
  2. Conducting collector trainings for a year
  3. Completing a "train the trainer’ course

IN ALL ABOVE CASES All trainers must have completed qualification training on the new rule!
